They are presumably in breach of Clause II.J.9 of their Registrar Accrediation agreement with ICANN (www.icann.org/nsi/icann-raa-04nov99.htm).  This clause says "Registrar shall abide by any ICANN-adopted policy prohibiting or restricting warehousing of or speculation in domain names by registrars".
