2. When there are mutually exclusive applications for the same top-level domain name, use the following rules to resolve conflicts:       Select the applicant organization that is not already designates a registry which is not already a      registry for top-level domains in the ICANN-administered root; and       Avoid giving contested top-level domains in the first round to organizations or consortiums that      represent more than 40% market share of the existing market for registry or registrar services in the      .com, .net, and .org top-level domains.
