Let me tell a REAL STORY: There is a MrBigShotCo
named XYZ in a BigShotCountry that occupied an empire called "XYZ.com". Then there
is a MrSmallShot who just bought a small piece of Cyber Land called "BestStuffOfXYZ.com"
(Cyber Home is not built yet). MrSmallShot’s intention is to provide expert-opinion
and public-opinion on the Best Stuff of XYZ.(making sure visitors know that the home
is not owned by XYZ, and the opinions are not of XYZ)The problem is, MrBigShot
has a Trademark for "XYZ", and does not like somebody else uses "XYZ". So like a
bullying warrior, it attacks MrSmallShot and orders to give up "BestStuffOfXYZ.com"
(otherwise ..), accusing "Bad Faith".
MrSmallShot has some cool ideas and knowledge,
but no gold to build arms and army to defend or counter-attack. So he does some "do-it-yourself"
research, and figures out 5 other Big-Shots and Not-So-Big-Shots own "XYZ" trademark.
And also there are at least 80 other Cyber Lands that include the mark "XYZ", some
homes are built, but mostly not yet.
MrSmallShot does not know what to do, as he
got no gold. To build and army is expensive. So he requests all of you to advice
on following:
1. Does XYZ has any right on BestStuffOfXYZ.com?
2. If MrSmallShot
has to give it up, can he send it to a Not-So-Big-Shot (who also owns XYZ trademark)
as a gift?
