Recommendations regarding the GNSO PDP

Proposals of ATRT2 Recommendations Regarding the GNSO PDP

As a former member of the BGC WG on the GNSO Review, which originally
recommended the amendments to the previous GNSO PDP, having carefully
analyzed the InterConnect Communications Report on the GNSO PDP and having
complemented it with my own appraisal on the current situation of the GNSO
PDP confronted with the RIRs’ PDPs, I propose the following recommendations
of the ATRT2 at this respect:

1)     The effects of the differing descriptions of the GNSO PDP between its
Manual <http://gnso.icann.org/council/annex-2-pdp-manual-16dec11-en.pdf>
and its  <http://gnso.icann.org/en/node/31379/> graphical representation in
the ICANN Web site, in one flowchart and 7 sub flowcharts, identified by
InterConnect Communications are sufficiently misleading to justify a
recommendation to unify both descriptions;

2)     The GNSO PDP

prescribes that upon approval of a PDP Charter the GNSO Council should form
a Working Group.[1] The GNSO WG´s deliberation rules and procedures are
prescribed by
<http://gnso.icann.org/council/annex-1-gnso-wg-guidelines-08apr11-en.pdf>
Annex 1 of the GNSO Operational Procedures state that they are steered by
the Chartering Organization. Incidentally, in this case, the Chartering
Organization is the GNSO Council. To this extent, ATRT2 should recommend
that for transparency the

Annex 1 should be amended to reflect this reality;

Annex 1 of the GNSO Operational Procedures prescribes that unless if a Chair
has already been named by the Chartering Organization (GNSO Council),
normally a Chair will be selected at the first meeting of the PDP WG.
However, this Chair needs to be confirmed by the (GNSO Council). In
addition, the Chartering Organization (GNSO Council) may nominate one of its
members as a Liaison to the PDP WG. However, not only it is ambiguous when
and how the Chartering Organization (GNSO Council) nominates a Chair or a
Liaison, but the long validated practice at the RIRs or at the IETF is that
Chairs of the PDP WGs are nominated by the respecting steering organization.
To this extent, it seems reasonable that the ATRT2 recommends that the
Chairs of the WGs should always be nominated by the Chartering Organization
(GNSO Council), with the advantage that as happens at the IETF and the RIRs
a pool of qualified and recognized Chairs could be conformed in advance; and

4)     The  <http://gnso.icann.org/en/node/40007> GNSO Briefing to the GAC
on PDP at Durban shows a lack of early awareness to governments about the
issues under discussion in the PDP WGs. To this extent, it seems reasonable
that ATRT2 recommends that the Chairs of the ongoing PDP WGs report directly
to the GAC at each ICANN meeting about these issues, in complement to the
GNSO Council report.

1.- In principle, the GNSO Council may form a different type of Policy Team.
However, to form a different type of Policy Team the GNSO Council need to
adopt before the specific rules and procedures to guide this Policy Team’s
deliberations.
