Thank you for the opportunity to weigh in on the Access to Curative Rights
Protection Mechanisms Policy Process.

I would like to voice my wholehearted support for the position elucidated
by George Kirikos, namely that domain name owners not have their right to
appeal to their national courts taken away by being forced into binding
arbitration. This is a recipe for manipulation of the system by bad actors
who could use this rule to forum shop for a favorable outcome (for
themselves).

The examples of obviously bad decisions in UDRPs that Mr. Kirikos cites are
the tip of the proverbial iceberg. Business owners must have the
opportunity to defend their claims in a court of law, not in an
all-too-easily-manipulated binding arbitration format.

I sincerely hope that ICANN will give appropriate weight to the concerns of
the many thousands of small business owners who rely on their domain names
for their livelihoods.
