Ladies and Gentlemen,
The European Bank for Reconstruction and Development (EBRD) fully supports the
comprehensive arguments submitted by the OECD. Particularly, the EBRD stresses
that the working group's elaborations on its recommendation #4 treat in an
offhand manner the significant likely effect of retaining the mutual
jurisdiction clause on the privileges and immunities granted to IGOs by their
member states. Additionally, the EBRD notes that arbitration is a widely
accepted and used method of dispute resolution, and one which is in this
instance appropriate in recognition of the international character of IGOs.
