Hi everyone,

Here is the request for registrar stats for our IRTP-D WG:


  *   A typical month would be 30-50 transfer disputes
  *   We resolve a quarter of them by working with other registrars
  *   The remaining domain names that were not successly returned were due to 
the following reasons:
     *   Losing registrar stopped pursuing the dispute
     *   The customers resolved the issues themselves
     *   Investigation determined one party of the dispute filed a false dispute

Dear all,

Following up on Kristine's message, this is the corresponding information that 
we received from the ADNDRC. https://www.adndrc.org/tdrp/tdrphk_decisions.html. 
As you can see on the site, in two of the total four cases the appeal was 
denied, once ADNDRC had no jurisdiction and in one case the the domain name was 
returned to the filing registrar.

In light of Charter question d ( Whether requirements or best practices should 
be put into place for registrars to make information on transfer dispute 
resolution options available to registrants) I have asked ADNDRC whether they 
also received requests by registrants and will get back to you as soon as I 
have received a reply.

To add some Provider data, the National Arbitration Forum has handled six TDRP 
cases.  We were still keeping strictly paper files for all of these so the 
files are at Iron Mountain.  The best I can do without requesting the boxes 
from storage is to extrapolate from notes made in our docketing system since 
TDRP decisions are not online.

In five of the cases (for sure, possibly all six), the filing party prevailed.
Three of the cases were definitely Appeals from a Registry decision.  It’s 
likely that five of them were, but I can’t say with absolute certainty.  The 
sixth decision may have been either a Request for Enforcement or an Appeal, I 
am not sure.

We have had many questions and people trying to file TDRPs, but we have to tell 
them that only their Registrar can file.

Dear all,

In light of the Group's discussion on TDRP we have  been in touch with transfer 
dispute providers to provide us with data from the cases they receive. We will 
share this with the group as soon as we have received and collated the relevant 
information.

In addition, we gathered some Registry-related TDRP data that might be useful 
to the discussion, too. I have attached a spreadsheet containing one sheet on 
the TDRP per TLD and a second sheet with an overview of the total number of 
TDRPs per month – both data sets are for the period of October 2009 to March 
2013.

You might notice that the numbers for 'lost' and 'won' TDRP are exactly the 
same each month. As this is too much of a coincidence, we assume that these 
represent the same case (as one party lost it and another won it) -  but maybe 
a working group member of the RySG might be able to clarify further.  Assuming 
that our assumption is correct the breakdown per TLD shows that:

of 227 total cases between October 2009 and March 2013

224 concerned .com (94.3%)
11 concerned .net (4.8%)
2 concerned .pro (0.9%)

For those of you interested, the data for these tables were sourced from the 
monthly Registry Reports filed with ICANN, see
