URS Must Account for Registrant Rights Too

ICANN -

The URS has supposedly been proposed to protect trademark holder rights.
Everyone acknowledges that trademark protection is reasonable.

However, and again monumentally important, are the rights of legitimate domain
registrants themselves. The wording and application of the Uniform Rapid
Suspension System must be crafted such that "reverse abuse" is practically
eliminated. This is a critical concern. ICANN have a well documented history of
affording litle consideration to individual domain registrant rights.
Consequently, registrants around the world are wondering how ICANN will protect
them from the cost & inconvenience of URS abuses.

George Kirikos has offered an intelligent stipulation to the proposed URS that
would minimize its potential misapplication. Let it only apply to domains
registered within the last 6 months. The UDRP has largely rectified "old"
infringement issues on domains registered years ago.

We (you) must ensure that the URS is not used as a mechanism to steal domains,
or used to interrupt the business of legitimate domain registrants. If ICANN do
not apply safeguards for domain registrants, then the URS becomes an easy,
cheap tool for Reverse Domain Name Hijacking.

One can only assume that ICANN have invested equal time in analyzing how to
prevent URS abuse & false claims of infringement. ICANN must not fail in this
regard.

Sincerely,
