It's not necessary in a sunrise challenge for the challenger to have trademark rights to the name, only that the challenged party *not* have trademark rights, since the sunrise period allowed only trademark holders to register domains.

If, however, the challenger didn't have a trademark on the name either, then the name is supposed to be released instead of transferred to the challenger.  If it got transferred to the challenger, then they in turn can get challenged if they don't have a trademark.
