You may be right in saying they don't follow their own rules...but if they don't they continue the lockdown their setting themselves up for lawsuits from trademark holders ('legitimate' and not so legitimate).  Remember, they have to give 15 days notice to rule changes prior to them taking effect. Afilias does not want any more GTLD's added anytime soon (less competition for .info and .com in the future) and that is why they continue to antagonize everyone (except ICANN that is who are in their pocket).
