Funding for ICANN

Since the decision in AIRA v. NSI and NSF (full cite below) which resulted
in rescinding the 30% infrastructure tax and lowering  domain registration
fees in .COM, NET and ORG -- was recently overturned, what will happen to
those funds?

Why can't they be used to bootstrap ICANN?
