Dear Mr. J. Postel,
Considering the importance of the process that ensures an international
approach with regard to the Internet governance, SITA would like to support
IANA in proceeding with a rapid incorporation of the new organization.
Nevertheless, the efforts for keeping the 30 September deadline should not
perturb the legitimacy of the Internet Corporation for the Assigned Names
and Numbers Bylaws and its Articles of Incorporation, that intend to
represent the thoughts of a worldwide private sector.
SITA firmly believes in a fair and open competition on a global marketplace
which leads to the development of new and competitive services, should be
the basis of the future Internet governance.
We have read the above mentioned document with great interest and are
writing to outline SITA's position on this matter, as follows:
- The Bylaws need to recognize the applicability of international laws. The
new organization will operate worldwide therefore some actions may have
legal consequences outside the Unites States;
- Section 4 (1.d and 1.e) (General Powers): Could imply ownership rights in
TLDs and IP addresses. This is questionable and unacceptable, in our view
as it leads to a preferential treatment of some commercial organizations;
- Section 6 (International Representation): Broader international
representation in the interim/future Boards needs to be improved. A more
equitable international representation and voting proceedings should be
ensured.
In this endeavour, we would like to make sure that these concerns are
brought to the attention of the parties involved and that due consideration
is given to the concerns of the international community when implementing
the process.
