The UDRP offers a speedy remedy to trade mark owners against the so-called
cyber-squatters. The UDRP applies to all domain name registrations in the
gTLDs and it may be used by ccTLDs through voluntary adoption (A full list
of UDRP voluntary adoption countries are available at
http://arbiter.wipo.int/domains/guide/index.html).
While presently there are eight UDRP providers worldwide
(http://www.icann.org/en/udrp/rdrp-providers.html ), there is no
"exclusivity" per se in terms of the number of UDRP providers- subject to
fulfilling certain criteria and the fees as per the application form.
The Internet community should also consider the fact that there have been a
number of significant developments affecting the Domain Name System (i.e.
multilingual domain names, gTLDs..etc). All these will inevitably generate
further trade mark domain name disputes and will require local knowledge and
expertise to be able to resolve the disputes effectively and speedily.
The AGIP proposal is reasonable, comprehensive, and robust. In my view,
there is no genuine reason why this should not go ahead successfully.
