I don’t wish to guess as to who encouraged this hearing or what the view of
staff is.
However, IP interests have long exercised considerable influence over this
Subcommittee, which has primary responsibility for patents, trademarks, and
copyrights. The same Subcommittee recently held two separate days of hearings
on "Promoting Investment and Protecting Commerce Online: Legitimate Sites v.
Parasites” – although Chairman Goodlatte has also stated that he opposes the
expansion of Federal domain seizure authority as proposed in last year’s Senate
COICA legislation. So the choice of venue is significant in that it means the
hearing will probably be more IP-centric.

Do you have a sense of where staff wants to take the hearing? Do you know who
instigated? Do you think it is more meaningful because it is a subcommittee of
Judiciary and not Commerce?
