One of the main subjects of discussion in the domain name industry today is the
subject of new gTLDs. One of the key issues for brand owners and consumers is
how to deal with abusive domain name registrations. As someone who a decade
ago signed into law the Anticybersquatting Consumer Protection Act - you led
the way against abusive registrations. However, you, yourself have been
targetted when someone registered <presidentbillclinton.com>,
<williamjclinton.com> and <williamclinton.com>. You filed a UDRP complaint
against the registrant seeking the transfer of these domain names, though
ultimately the panelist denied your claim - somewhat surprisingly in my view as
the panelist decided that the registrant was not acting in bad faith. I thus
have three questions: (a) how you felt about losing this case? (b) how you
felt about your wife having succeeded in her UDRP complaint with almost
identical facts concerning the domain name <hillaryclinton.com> and, somewhat
more seriously (c) how critical do you think the protection of consumers and
brand owners rights are at this pivotal point in the history of the Internet
where we will be faced with hundreds if not thousands of new gTLDs in the
coming years.
