Community and ICANN,

There are some fundamental problems with the genesis of ICANN’s more recent WHOIS efforts. It is false that the origins of WHOIS are shrouded in mystery and that there is no policy. The intent of WHOIS is actually quite clear and there is sound policy. That policy has been routinely ignored and not paired with proper enforcement. What is the policy and where did it come from?

The RFC which launched the domain name system plainly states:

“There must be a responsible person associated with each domain to be a contact point for questions about the domain, to verify and update the domain related information, and to resolve any problems (e.g., protocol violations) with hosts in the domain.”

Someone must be responsible for the domain and be contactable. This has not changed, and has in fact become more serious. What kind of information should be in WHOIS? According to RFC 3912 states the records are for “non‐sensitive information.”

Any efforts to further restrict access to domain records not only violates the AoC but also the first, and correct, principles of the system.

By changing the name of WHOIS to something new, ICANN is attempting to bury the meaning and responsibility over it.
