But Evan, we did not eliminate measurements that would be potentially 
embarrassing.

In this draft, we have separate metrics for registrants and for users, where we 
directly measure their "understanding" as a result of plain language disclosure 
or other ways that foster understanding of a TLD's restrictions, such as 
advertising, registrar websites, etc.     We now have 2 metrics to replace the 
4 we had in the previous version:

[2.1] Measure potential registrants’ understanding of TLD benefits and 
restrictions, such that potential registrants can make informed choices about 
registration of their domain names.  This measure includes only open gTLDs.

[2.2] Measure Internet users’ understanding of TLD eligibility restrictions, 
such that Internet users can make informed choices about reliance on domain 
names in that TLD.    (This measure includes all gTLDs.)

Each of these Measurements calls for user surveys and audits of websites.   
That's where potentially embarrassing data would be gathered and published 
widely.

In my view, that's not significantly different from the draft you had 
previously agreed to.   Help me understand your angst, Evan!

I can understand how industry would want to eliminate measurements that would 
be embarrassing, by obsessing with contractual distinctions between categories 
of TLDs that are not apparent to the public. That ICANN is seen to be beholden 
to its industry's manipulation of metrics to avoid perception of failure is 
understandable, if completely transparent in its self-interest. But that's not 
the biggie.

The biggest dealbreaker for me, though, is the move from audits (objective, 
moderately easy to measure) to determinations of "understanding" (highly 
subjective, expensive to administare well, nearly impossible to protect from 
bias). Such a major last-minute modification renders a substantial portion of 
the metrics effectively useless (and IMO is worse than doing no metrics at all).

I believe the letter accurately and fairly incorporates the revisions we 
discussed.  I do wonder, though, if it would be possible  to somehow address 
Evan’s comments, most of which we did address in our telephone conference 
deliberations – but without the direct participation of Evan.  I do believe the 
concerns Evan expresses have been addressed and, where appropriate, 
incorporated in the metrics and in the introductory letter.
