The RyC statement says "Public Interest Registry (.org) would be compelled to alter its present policy known as the Excess Deletion Fee."


While this is true, as Jeff pointed out that the .com agreement states: "Registry Operator shall be afforded a reasonable period of time following notice of the establishment of a Consensus Policy or Temporary Specifications or Policies in which to comply with such policy or specification, taking into account any urgency involved." and the .org agreement includes an identical statement. As long as the .org monthly statistics clearly show there is no excessive use of the AGP (whether due to the Excess Deletion Fee or whatever), then "urgency" is not an issue and they can defer implementation until convenient (with the concurrence of ICANN staff).

The same applies for any other registries that have an AGP but are not experiencing tasting.
