As discussed a bit earlier in the call:
If the Lock Working Group is going to include within its deliberations
processes for unlocking as well as locking of UDRP-disputed domain name (as
appears logical), we would suggest that this be clarified with the GNSO Council
for purposes of the Group's Charter, and if necessary (which as discussed on
today's call, there seems to be a sense that such a "formal" amendment might
not be needed, but in an abundance of caution, we suggest querying the Council
to this end), that a corresponding amendment to the Charter (e.g. referring
expressly to "unlocking" be made. (That is to say, if the WG would invest its
time and resources in considering the issue of unlocking, and make
recommendations in this respect, that these would be appropriately considered
by the GNSO).
In addition to locking to prevent transfers in breach of paragraph 8 of the
UDRP during pendency of UDRP proceedings, there are a number of points during
the pendency of, or following completion of, a UDRP process, in which a
disputed domain name may need to be unlocked, including, for example, in order
to give effect to any settlement agreement reached between the parties prior to
panel appointment, or following notification (in order to implement) a panel's
decision pursuant to UDRP 4.k.
