STATEMENTS OF INTEREST Statement of Interest for KRISTINA ROSETTE for the Working Group to Protect the Rights of Others (PRO) I am employed as a Special Counsel by Covington & Burling LLP (“Covington”), a general practice law firm with over 600 lawyers in five offices in three countries. I am resident in Covington’s Washington, DC office and am a member of the District of Columbia bar. Since 2004, I have been a member of the Registration Practice and DNS Administration Subcommittee of the International Trademark Association’s Internet Committee. I am also the Intellectual Property Constituency representative for North America to the GNSO Council. I specialize in Internet and trademark matters, and represent trademark owner clients in connection with such matters. Among my responsibilities, I develop and implement offensive and defensive domain name registration, Internet monitoring, and enforcement strategies; reclaim domain names through negotiation, arbitration, and litigation; and advise clients on the use of keywords and sponsored links. With specific regard to the previously implemented protective mechanisms, I have advised clients of participation and registration requirements, have assisted in asserting claims and securing registrations, and have initiated challenges to third-party registrations under the .biz STOP and .mobi Sunrise Challenge policies. I prepared the INTA Internet Committee’s informal comments to EURid regarding Commission Regulation (EC) No. 874/2004 and was one of the committee members who met with the leadership of the PricewaterhouseCoopers .eu validation team pre-launch to discuss questions and issues of concern to trademark owners. I have determined that Covington does not represent ICANN and does not represent any clients in matters in which ICANN is an adverse party. Covington did represent the International Cooperative Alliance in connection with the formation and establishment of DotCooperation LLC, the .coop registry operator, but that matter has been closed for some time. I have also determined that Covington neither represents any gTLD or sTLD registry operator in matters relating to its capacity as a registry operator nor represents any client in matters adverse to such registry operators as registry operators. Based on the responses to my inquiries, Covington does not represent any ccTLD registry operator in its capacity as a registry operator nor does it represent any client in matters adverse to any ccTLD registry operators as registry operators. To the best of my knowledge, Covington does not represent any ICANN-accredited registrar in its capacity as a registrar nor does it represent any firm client in a matter adverse to a registrar as registrar. From time to time, Covington has represented firm clients in intellectual property matters adverse to registrars, and it is likely to do so periodically in the future. I have not been involved in such matters. It is possible that a firm client is an ICANN-accredited registrar, but, if so, Covington does not represent it in such matters. ......................................................................... GRIFFIN for the Working Group to Protect the Rights of Others (PRO) I am Executive Counsel, Corporate Legal, at The Walt Disney Company (“Disney”), a leading media and entertainment company with interests in studio entertainment, parks and resorts, consumer products and media networks. I am responsible for issues involving Internet piracy, including domain names and related issues. Prior to joining Disney, I was an associate at the New York office of White & Case, and represented a variety of clients with respect to intellectual property issues, including issues involving domain name registration during the sunrise process. I am a member of the Bars of Massachusetts and New York.
Statement of Interest for VICTORIA McEVEDY for the Working Group to Protect the Rights of Others (PRO) I focus on intellectual property and media law and am resident in London. I am qualified in England and in New York State and previously worked for Morgan Lewis and Bockius and Wilmer Cutler and Pickering. I have substantial experience of trade mark litigation and took the first case to the House of Lord under the 1994 Trade Marks Act, based on the harmonizing Directive. I am an independent expert to Nominet’s .co.uk Panel, and also to the .EU Panel. I am also on WIPO’s Panel of Arbitrators. ......................................................................... Statement of Interest for KELLY W. SMITH for the Working Group to Protect the Rights of Others (PRO) I am employed by Intel Corporation as a Senior Attorney, Trademarks & Brands. Intel Corporation is the owner of several famous trademarks, including the INTEL and PENTIUM marks. I am resident in Intel's headquarters in Santa Clara, California and am a member of the California state bar. Since 2004, I have been a member of the Registration Practice and DNS Administration Subcommittee of the International Trademark Association's Internet Committee. In addition to my general representation of Intel in trademark clearance, licensing, and enforcement issues, I manage Intel's worldwide domain name portfolio, making decisions regarding offensive and defensive domain name registration, developing domain name enforcement strategies, and asserting challenges to abusive domain name registrations. As a member of the above-referenced subcommittee, I assisted in preparing comments concerning the rights protection mechanisms proposed by applicants for sponsored TLDs, and (with others) met with the leadership of the PricewaterhouseCoopers .eu validation team pre-launch to discuss questions and issues of concern to trademark owners. ........................................................................... Statement of Interest for PETER GUSTAV OLSON for the Working Group to Protect the Rights of Others (PRO) I am an attorney at Plesner, one of the largest law firms in Denmark. Before joining Plesener in 2000, I was at Internationalt Patent-Bureau, a large Danish patent and trademark agency, where I was webmaster in 1996 and set up their domain name registration service in 1997. Though I was born and raised in the U.S., I have been living in Denmark for more than 20 years, and am a member of the Washington D.C. Bar (inactive status) as well as the Danish Bar. I have been a member of the International Trademark Associaton (INTA) Internet Committee from 1997-2001 and again from 2003 to the present. In this regard I assisted in forumlation of the ICANN UDRP in 1999 and was one of the committee members who met with the leadership of the PricewaterhouseCoopers .eu validation team in 2005 to discuss questions and issues of concern to trademark owners. Statement of Interest for MICHAEL PALAGE for the Working Group to Protect the Rights of Others (PRO) I am currently a member of the following three GNSO Constituencies: the Business Constituency (BC); the Intellectual Property Constituency (IPC), and Registry Constituency. Within the BC I participate and vote on behalf of my consulting company. I also participate within the IPC as licensed attorney admitted to the bars of Pennsylvania and Florida, however, under the IPC charter I have no voting rights as an individual IP attorney. My involvement within the Registry Constituency is on behalf of dotCoop the registry operator of the .COOP sTLD for whom I serve as a consultant/advisor; however, Carolyn Hoover is the designated voting representative for dotCoop. My participation within this Working Group will be in an individual capacity in which I will attempt to share my rather extensive background on this particular subject matter including: participating in the original drafting of the UDRP as the Chair of the Registrar Constituency; as Chair of ICANN's Working Group B that was tasked with the protection of famous trademark in the original WIPO Domain Name Report; as author of the original Sunrise concept as discussed in the Working Group B Final Report; as a consultant to Afilias who was involved in the drafting and implementation of their Sunrise process; and as a consultant to mTLD in connection with the drafting of their Sunrise and Premium Name processes. In addition to serving as a consultant/advisor to dotCoop, I also currently serve as a consultant to Afilias the registry operator of the .INFO TLD. I also provide consulting services to ccTLD operators, registrars, and other registration authorities on an as needed basis on a wide range of topics. I have also provided expert testimony in state and Federal court on behalf of various brand holders and law enforcement agencies in connection with domain name and internet related matters. Previously I served as the Chair of the Registrar Constituency from its inception in 1999 until 2003, when I served a three-year term on the ICANN Board of directors (2003-2006).
February 20, 2007 I am Vice President of Corporate Development and Policy for The Go Daddy Group, Inc. The Go Daddy Group companies include eight ICANN accredited registrars, each of which may benefit from the possible introduction of new gTLDs. GoDaddy.com, one of the Go Daddy Group registrars, is a member of the dotMOBI Advisory Group (MAG). I represent GoDaddy.com on the MAG. The MAG, among other activities, is involved in recommending policy to mTLD, the dotMOBI Registry Operator. GoDaddy.com is a member of, and I am CTO and Vice Chair of the Registrars’ Constituency of the GNSO. While I was not elected by the Constituency to serve on this Working Group, I am on the Executive Committee of the Constituency and feel an obligation to present and discuss various Constituency members’ views to the Working Group as they are made known to me. GoDaddy.com is also a member of the United States Council for International Business (USCIB). The USCIB is a member of the Business Constituency of the GNSO. Our primary interest in the USCIB is the DNS and Internet Identifiers Working Group. The USCIB and aforementioned Working Group include members who have an interest in the introduction of new gTLDs and how such introduction may be structured in regards to the protection of existing rights of others, particularly Trademark and other Intellectual Property (IP) rights. My primary interest in this Working Group is the opportunity to provide input on the necessity of protecting IP rights during the launch of new gTLDs, and if it is determined that such protection is necessary, providing input on the process so that mistakes of the past are not repeated. I have previously submitted a brief white paper on the subject of Sunrise and Landrush to the GNSO and have attached it separately in the interest of full disclosure. Statement of Interest from MARGIE MILAM for the Working Group to Protect the Rights of Others (PRO) I am the Vice President, General Counsel and Corporate Secretary of MarkMonitor, Inc., an ICANN accredited registrar based in Boise Idaho, and am responsible for MarkMonitor’s ICANN policy initiatives. MarkMonitor is the leading corporate domain registrar focusing primarily on managing the large and complex global domain portfolios of multinational corporations. MarkMonitor provides additional value added services to its corporate clientele, such as online brand protection and fraud prevention services. MarkMonitor actively participates in the sunrise launches of gTLDs and ccTLDs by developing procedures and programs to assist clients manage the sunrise process. MarkMonitor is affiliated with a number of registrars utilized in connection with the launch of ccTLD and gTLDs, such as in the launch of .eu. My primary interest in working with this group is to identify ways of simplifying and standardizing sunrise procedures as a registrar that actively participates in the launch of new TLDs. MarkMonitor is a member of INTA, IACC, Anti-Phishing Working Group, and LES. I currently serve as MarkMonitor’s representative on the ICANN Registrar Constituency, and serve on the Internet Committee of IACC and the INTA Services Committee. I am also frequent speaker on intellectual property issues. Interest Statement of JON NEVETT for the GNSO Working Group on Protecting the Rights of Others February 27, 2007 I am Vice President of Network Solutions, LLC, responsible for policy, government affairs, and business ethics. Network Solutions includes three ICANN accredited registrars, each of which may benefit from the possible implementation of new TLDs. Network Solutions is a member of the Registrar Constituency (“RC”) of the GNSO. In May 2006, I was elected Chair of the RC. While I was not elected by the RC to serve on this Working Group, I am on the Executive Committee of the RC and have an obligation to present and discuss various RC members’ views to the Working Group as they are made known to me. Network Solutions also is a member of the United States Council for International Business (USCIB). The USCIB is a member of the Business Constituency of the GNSO. Our primary interest in the USCIB is the DNS and Internet Identifiers Working Group, of which I am Co-Chair. The USCIB includes members who will have an interest in the implementation of new TLDs. I also serve on the Direct Marketing Association’s Interactive Marketing Board. My primary interest in the Working Group is the opportunity to provide input on the necessity of protecting Intellectual Property rights during the launch of new gTLDs. If it is determined that such protection is necessary, providing input in the process so that ICANN arrives at a fair method of registration of domain names related to the intellectual property rights of prospective registrants. ........................................................................... MAHER for the Working Group to Protect the Rights of Others (PRO) I am Senior Vice President - Law and Policy of Public Interest Registry, a nonprofit corporation responsible for management of the registry of the .ORG top level domain. From 1999 until 2002, I was Vice President - Public Policy of the Internet Society. In 2002, I became founding Chairman of the Board of Public Interest Registry, and served in that capacity until August, 2004. I am a member of the Bar of New York, Illinois and Wisconsin and a registered patent attorney with the US Patent and Trademark Office. I am a director of the Better Business Bureau of Chicago and Northern Illinois, Inc. I am a retired partner of the law firm, Sonnenschein Nath & Rosenthal, LLP, in the US, and have no connection at this time with any of its present or former clients. NEUMAN, Esq.for the Working Group to Protect the Rights of Others (PRO) I am the Senior Director of Law, Advanced Services & Business Development for NeuStar, Inc. NeuStar, is the registry operator for the .biz generic Top-Level Domain and the .us country code TLD. NeuStar also provides back-end registry services for the .travel and .tel TLDs. In addition, in April of 2006, NeuStar acquired UltraDNS Corporation who provides managed DNS services for several thousand enterprise customers in addition to providing DNS-related services for a number of gTLDs and ccTLDs, including .info, .mobi, .org and .uk. I started my career as an intellectual property attorney advising and representing a number of large clients on the protection of their trademarks and copyrights on the Internet in the mid 1990s. In 1997, I became an active member I the American Intellectual Property Law Association, a large supporter of the Intellectual Property Constituency at the time, and was the primary drafter of the original Sunrise/Daybreak processes in 2000. Shortly thereafter I began working for NeuStar, Inc. and was responsible for the creation, implementation and administration of all policies related to the launch and management of the .biz top-level domain. As many of you know, for .biz, we did not launch a Sunrise process, but successfully administered an IP Claims process which provided an opportunity for IP owners to notify .biz applicants of their claimed intellectual property rights in particular .biz domain names. In late 2001, NeuStar was awarded a contract to administer and operate the .us TLD where we were required to launch a formal Sunrise process. Dot-us was the first top-level domain (either ccTLD or gTLD) to launch a Sunrise process that actually verified the information submitted through applications with the applicable national patent and trademark office. Since 2002, I have advised a number of sponsored TLDs on their launch processes, including the .travel domain, which successfully launched without any Sunrise or other Intellectual Property protection services. I look forward to serving on this group.
I am a nomcom Appointee to the council, and believe that part of my responsibility as a volunteer to the council is to participate in as much of the work as possible. I am employed as a research consultant at Luleå University of Technology in Sweden where my funding comes from general University funds, Swedish nation research funding and ETRI, a research institute funded by the S. Korean government. I also have a contract doing QoS R&D for a Swedish start-up and am occasionally employed as a consultant to the secretariat of the IGF. I do not belong to any of the ICANN constituencies, though I do belong to several of the organizations that are members of the NCUC. I am also a registrant of several TLDs.
