I think the intent is that ICANN would indeed use an outside panel with
appropriate expertise to determine whether a string is "confusingly
similar".
I note also that ICANN uses outside panels to determine "technical"
issues as well. I am not sure I would describe ICANN as a "technical
body", but would describe it as a "coordination" body.
The wording regarding the public policy issues is certainly not final
wording - just a place holder until we get some further public policy
advice. What we don't want to have happen is for an applicant to go
through the expense of applying, and then find later on that the string
is rejected for "political" reasons. The key here is to obtain some
certainty in the process.
