Summary and Analysis of Comments For:
Revised Proposed Bylaws Revision from ICANN Nominating Committee
19 December 2008
ICANN staff has prepared this summary and analysis of comments received on the
proposed Bylaws amendment from the 2008 ICANN Nominating Committee to update
the diversity requirements for selecting ICANN Board members to include
domicile with country of citizenship. The comment period ran from 17 November
to 17 December 2008. The original comment period ran from 23 September to 23
October 2008. 3 comments were received during the second comment period.
15 comments were received from 14 individuals (1 individuals commented twice)
on the original Sept-Oct comment period, summarized at
http://forum.icann.org/lists/nomcom-bylaw-revision/msg00015.html. The public
comments on this forum are archived at
http://forum.icann.org/lists/nomcom-bylaw-revision/.
David Archbold commented, "As I was critical of the previous draft amendment, I
should record that I have no objections to the current version." See
http://forum.icann.org/lists/nomcom-bylaw-revision/msg00016.html.
Eric Dierker wrote that "citizenship should be a requirement....perhaps by-laws
should be more concerned with an outreach and less concerned with restrictions.
The restriction of citizenship reflects the necessary commitment to the
region." See http://forum.icann.org/lists/nomcom-bylaw-revision/msg00017.html
Carlton Samuels wrote that he thought the proposed amendment was flawed, but
suggested adding domicile as another condition. "If we would wish to address
the matter of persons of dual citizenship serving in the context of Board
diversity, then it would be far more useful to keep citizenship and ADD
domicile as a test condition, with a greater weight given to citizenship."
Carlton also raised an issue of diversity of ICANN staff. See
http://forum.icann.org/lists/nomcom-bylaw-revision/msg00018.html.
Next Steps
The Board will consider the public comments along with the proposed Bylaws
amendment at its next available Board meeting.
