Subject: IPC draft redline of RAA
 
Dear Kurt,
 
Following up on our previous conversations, and on the phone call with the
IPC task force on the RAA revision process in which you participated,
attached please find a DRAFT redline of the current Registrar Accreditation
Agreement (RAA).  It has been prepared by a task force of the IPC and
approved by the IPC for submission as a contribution to the process of
revision of the RAA.  Per your suggestion, we are observing the September 10
public comment deadline for submission of this draft redline. 
 
The changes are intended to address a number of the issues previously
identified as under discussion between ICANN and the registrars as part of
the RAA revision process.  It also expands somewhat beyond those issues to
address topics such as more detailed ground rules for proxy/private
registration services (see, secs.  3.3.9, 3.7.7.3) and registrar
responsiveness and accessibility (see sec.  3.7.10). 
 
Some previously identified revision issues are noted only as placeholders in
this draft, e.g., graduated sanctions for non-compliance with contractual
obligations, sec.  5.3.9.  The task force concluded that graduated sanctions
are likely to be negotiated between ICANN and the registrars directly and
that it would be more sensible to react to what those negotiations produce
rather than try to devise a graduated sanctions system on our own.  Of
course, IPC has long supported the introduction of graduated sanctions as a
key means of achieving better compliance with contractual obligations. 
 
IPC views this submission as a first step - and, we hope, a constructive
contribution - in what we understand will be an iterative process of revising
and improving the RAA.  We look forward to your review, and that of
registrars, and would be glad to answer any questions concerning this draft.
