I am posting this is my capacity as Chair of the Internet Committee of
the European Communities Trade Mark Association (ECTA) which is the
principal pan-European body representing the interests of those
professionals who practice within the European Union in the fields of
trade marks and related IP.  

 

Internet fraud damages the global economy and sales of counterfeit goods
including pharmaceuticals threaten the lives of those who are sold them.
In order to combat IP crime on the Internet and to promote safe online
trading, it is essential for trade mark owners and those who combat
counterfeit goods to have access to accurate, up-to-date contact
information on domain registrants. Free access to reliable up to date
Whois information is essential. Any new limitations on access to
information held in Whois databases would cause great concern. Such
limitations will impede trade mark owners' abilities to protect
themselves and their customers against fraud and may encourage further
infringement and fraudulent trading.

 

Even if a decision is made to not publish registrant details it is
essential that these be made readily available to those such as law
enforcement bodies and rights holders who have a legitimate interest in
obtaining that information.
