at Gamma Entertainment, we are 100% opposed to .XXX and the entire plan
by ICM Registry.<br>

can already find all the adult content that they want. Very easily at
that. Since ICM Registry's "official" plan does not include
regulations to force adult website in the .XXX tld and that the current
websites distributing adult content are not going away, it will simply
create a bigger market place, with the SAME amount of customers. There
is NO new business to make the adult industry as a whole grow in this
proposition. <br>
</p>
<p style="margin: 0px 0px 15px; padding: 0px; clear: both;">We don't
agree with the concept that it will create a "safe place on the web to
view adult content". Any online industries have there share of fraud
going on. When you consider that the all the actual "regulators" (FTC,
DOJ, Google, ISPs, Cards Associations, etc) are not really able to
prevent new schemes, I can't even consider the possibility that ICM
will succeed. The security feeling that ICM tries to put forward will
not work.<br>

<p style="margin: 0px 0px 15px; padding: 0px; clear: both;">So the end
result will be that ICM Registry will make money and the market will
have shifted between exisiting/new adult content provider. And the
same customers will still be seeing the same adult material as they are
now, but potentially on different tld. The customers will not have any
new opportunities and the companies operating in adult industry will
not have gain any advantages, but will not incur significant new costs.<br>
</p>
<p style="margin: 0px 0px 15px; padding: 0px; clear: both;">We also
want to point out that we had pre-registered 543 .XXX domains back in
2007, as a defense mechanism to this menace to our business. While we
pre-registered the domain, at that time, we had emailed both ICANN and
ICM Registry to make clear that we didn't support .XXX. I hope those
communications were considered and that ICANN was able to verify that
ICM didn't include our name as "company from the adult indutry that
supports .XXX". The lack of transparency from ICM and the process
doesn't allow me to confirm or not if we were considered as a supporter
of ICM's plan. See attached copies of the communications.<br>
</p>
<p style="margin: 0px 0px 15px; padding: 0px; clear: both;">Also, with
the actual process moving forward, it is crucial to provide enough time
to the adult industry to respond properly and accordingly should ICM
ever provide the requested information. It is very troublesome that we
don't have the guidelines or full disclosure on who will create those
guidelines for something that could disrupt our industry in a huge way.<br>
