The proposed .xxx top level domain should not be enacted. As a voluntary
measure, the new TLD will accomplish nothing with respect to shielding
children from adult content, as all current .com adult domains would
continue to operate as they do presently.
In terms of the new TLD's benefits to adult internet businesses, I see no
advantage to .xxx over any other available extension, and - hampered as
their options may be by the as yet undefined "best practices" - the new TLD
may, in fact, present significant disadvantages when compared to .com's,
.net's, etc.
In short, as a voluntary measure, .xxx is useless. Were use of .xxx domains
for sexually explicit content become mandatory (something which the
applicants themselves oppose stringently) it would clearly constitute an
impermissible prior restraint on free speech.
For the reasons above, and many others addressed in other submitted
commentary, I respectfully request that the ICM Registry application for the
new TLD be rejected.
