There is an army of lawyers out there that would make the idea of placing DNS names outside trademark rules totally inapplicable, at least for existing TLDs.

On the other hand, chartered TLDs may specify in their declaration of principles that no name in the domain has any relation with trade marks. Of course, all of them must be non-commercial and must have some method of enforcing the adherence to the charter.
