You are both correct. It depends on WHICH .com holder you are talking about.

Also, the introduction of new TLDs will open up more litigation, just from a different source than a narrowing landscape on .com.

i.e.  Believe.com suing Believe.biz.      eRoad.com suing eRoad.web.

etc.


ICANN better be VERY clear on the criteria that a complaintant's complaint must meet even before they can BEGIN filing. (If that's even feasible.)

Too many words in the languages of the world.
