ICANN is not a legal authority and does not have the legal control or power to stop
any business from selling domains in TLDs, regardless of whether or not those TLDs
have actually been authorized. Essentially, ICANN's sole recourse is to warn people
that pre-registrations in new TLDs have not been authorized by ICANN. If they were
to go out and specifically name the companies engaging in this business, they would
open themselves up to legal action. So by ICANN NOT telling you that your registration
is invalid, they are not saying that it is. They are (properly) staying within the
confines of their authority and power. Furthermore, I'd be happy to sell you the
Kepler crater on the moon for $35. I'll even print out a time-stamped receipt that
says "The moon crater Kepler has been registered in your name. You are now the owner
of this crater." I doubt any government will tell you that you don't own it, but
it certainly won't mean that you do.
