Ladies and Gentlemen,
The Inter-American Development Bank strongly supports the arguments submitted
by both the OECD and WIPO's Arbitration and Mediation Center and urges ICANN to
recognize that IGOs merit protection consistent with their treaty-based nature.
Upholding IGOs' immunities, via a tailored dispute resolution mechanism, will
inure not only to the benefit of IGOs themselves, but of donors that support
them and, most critically, the citizens they strive to aid. Specifically,
arbitration proceedings, as explained by OECD and WIPO, could avoid potential
inferences of IGOs waiving their jurisdictional immunities while allowing for a
fair and well-known grievance mechanism to be in place. Further, this would be
consistent with IGOs' practice when dealing with potential contract disputes.
Please consider these brief remarks as an endorsement of OECD and WIPO's
detailed arguments, which could well serve as guidance for ICANN to take the
required steps to recognize and protects IGOs' legal nature.
