In my opinion the notion of "chains of certification" simply moves the
problem we are trying to solve from the access process to the
certification process, without necessarily gaining any ground. It
raises all the same questions about which third parties get what type of
access under which conditions.
I think you are on much firmer ground when you say:

This is exactly right. I think the whois problem is a relatively simple
one compared to the broader issue of online law enforcement and fraud
countermeasures. If we confound the two, we will never solve the problem
because whois simply cannot bear the burden that would be placed on it.
As the OPTA participant noted, proper takedown procedures are needed and
other kinds of cross-jurisidctional LEA cooperation and private sector
cooperation will do more to address the basis of these problems than
whois access.
