Regarding the UPU's comment in reference to the Nairobi Treaty (Column E, Row
4), the IOC respectfully submits the following concerns.
The IOC agrees that the Nairobi Treaty is limited in scope to the protection of
the Olympic Symbol (five interlocking rings). In fact, the IOC expressly
acknowledges that fact under "Scope of Protection and Limitations." However,
the mere existence of the Nairobi Treaty demonstrates that the international
community has acknowledged that the intellectual property of the IOC is
particularly vulnerable and that the organization itself is worthy of special
protections. The IOC believes that the Nairobi Treaty is relevant to the
inquiry of this group for that reason. Many countries have followed with
legislation that protects the Olympic words for the same reason that the
Nairobi Treaty was enacted.
We respectfully suggest that concerns about the relevance of the Nairobi Treaty
to the work of this group are best addressed under "Connection of Identified
Harm to the National Law." We believe that answering "no" to the inquiry about
whether the IOC enjoys treaty protection is misleading.

Dear Berry and All,
Please find attached the UPU's comments and suggested edits to the spreadsheet
(marked in blue italics), which are particularly necessary in order to correct
certain legal inconsistencies and statements concerning the status of IGOs (as
well as the necessity for protection of their names and acronyms). Other
revisions of a more fundamental nature would also be necessary as far as the «
nature of the problem » is concerned.
