Hi, Jeff

As part of the PEDNR WG agenda for today, one of the items is to, "Pursue the 
availability of further information from ICANN compliance staff to understand 
how current RAA provisions and consensus policies regarding deletion, 
auto-renewal, and recovery of domain names following expiration are enforced; 
(please see http://forum.icann.org/lists/gnso-pednr-dt/msg00003.html).

This audit update fulfills this part of the agenda.

This makes sense and realized the EDDP covers this after I sent the message.

That being said then can I ask a simpler question - if these issues are covered 
under the RAA and EDDP and the ICANN compliance team watches over this as part 
of contractual issues, why is this being covered under a Working Group and PDP?

As you know, the EDDP revises the domain registration expiration provisions in 
ICANN's RAA.

3.7.5.6 "If Registrar operates a website for domain registration or renewal, it 
should state, both at the time of registration and in a clear place on its 
website, any fee charged for the recovery of a domain name during the 
Redemption Grace Period."

You are right- the new RAA contains section 3.7.5.6 whereas the old one does 
not.  The EDDP, a consensus policy, was posted by the Board on 21 September 
2004 and started to take effect on 21 December 2004- several years after the 
RAA version 2001 was adopted.  This and other consensus policies apply to 
registrars under the old RAA (I believe this is covered in section 4.1.1 of the 
old RAA).

I do have a question regarding the claim that Many registrars fail to post fee 
(over 500). The section that you refer to 3.7.5.6 of the RAA refers to the new 
RAA and the new requirement to post the RGP fee.

I assume that the audit you completed only researched Registrars that signed 
the new RAA. Can you please confirm to the group.

Members of the PEDNR WG,

ICANN Compliance recently completed an audit of all registrar websites to 
establish if they were compliant with the Expired Domain Deletion Policy as it 
relates to fees charged to registered name holders for recovering domain names 
that have entered the Redemption Grace Period (RGP) (please refer to section 
3.7.5.6 of the EDDP).  A large number or registrars- close to 500 of them- 
posted information on their websites in relation to recovering domain names 
that are in RGP which either either did not mention fees or mentioned them but 
did not specify any amount (e.g., "fees will apply").

The EDDP requires registrars to post on their website the actual fees charged 
to registered name holders for recovering domain names that are in RGP.  
Compliance will be posting an advisory and reaching out to registrars in the 
very near future to clarify this requirement.
