How does ICANN learn about instances of Cyber-squatting ( issue 1.1),
Front-running (issue 2.1) and Warehousing (issue 2.2) ? The stakeholder
recommendation on these issues are to prohibit, penalize or even terminate
accreditation, but what is the mechanism by which ICANN would get to know
about such practices? It is not enough for ICANN to act upon complaints
received, or to act upon Registrars' self-disclosure of such practices. What
is required is an auto-detect and alert mechanism - a system of
auto-reporting of instances of a sizable number of domain names registered
for one or a group of make-believe 'Registrants' . Such instances of
abnormal transactions could get auto-reported to a Council of Registrars/
ICANN as activities suspicious of Cyber-squatting, Front-running or
warehousing. Erring Registrars may not indulge in such activities in their
own names, if these activities are expressly prohibited. They may choose to
do so in the name of a business Front, or in the name of family members /
affiliates. In any case, unusual bulk or repetitive transactions would get
auto-detected and then looked into, to determine the nature of the activity
and to establish the inappropriateness of such activities and recommend
punitive measures.
