The main areas that have been highlighted are:
- before deciding to send the proposal to the Security Panel or to an
external competition regulator, the ICANN staff need to make a judgement
and may seek expert advice
- the process for seeking the initial expert advice needs to be
clarified
- with respect to competition issues, registrars feel that some
registrars should be consulted to provide input as part of the expert
advice
It would appear to me that in addition to a Standing panel on security,
there may also need to be a Standing panel on competition issues. One
or members of the standing panels could be consulted to provide "expert
advice" when ICANN makes its preliminary determination.
