"Whois" policy development

Sportsman's Market, Inc. (Sporty's) uses its assigned domain name
"sportys.com" as a material part of its well-known 40 plus year old
business.  This domain name was transferred from a cybersquatter by court
order only after extensive litigation.  Its trademark "SPORTY'S" (the
"Mark") is registered in the U. S. in several trademark international
classes and is a very valuable asset.  Over the past decade more that sixty
competitors have attempted to confuse Sporty's customers by misusing
Sporty's Mark on the Internet.  Using "Whois" Sporty's has been able to
successfully clear up misunderstandings and by identifying and communicating
with these persons who are misusing the Mark on the Internet 

 

The free "Whois" function is a very needed and important part of the
Internet.  As a result of its experience Sporty's urges GNSO Council members
to support Motion 2 (and reject Motions 1 and 3) at the meeting scheduled
for October 31, 2007.  Your consideration of these comments is appreciated.
