Since I'm not a lawyer, I really don't know the intricate workings of the law. It
would seem to me that usage should constitute some form of ownership or claim. It's
obvious from the fact that different courts have made different rulings that this
will one day need to be settled in a higher court. Your guess is as good as mine
as to what that court will decide. It's obvious that the courts are lacking in knowledge
when it comes to the Internet and technology, so I really wouldn't be surprised if
the ruling made no logical sense. I assume that the California court ruling stands
only in California, and was given the case because IOD is a California company and
the claim was made in California. Since I know we've got some lawyers participating
in this forum, it would be interesting to hear their perspective on this issue since
they know the law better than people like I do.
