I think Afilias knew from the getgo that they would be the most likely candidate.  Why should they bother answering the concerns of the public when its all done behind closed doors? Given that afilias had plenty of icann experince in their pocket it does look like an incestuous transaction with IOD and internet users treated as nothing more than a mild annoyance.
