To Whom It May Concern:

 

I am gravely concerned that ICANN is considering eliminating the Whois
requirement for GTLD's.  This tool is essential for us in our battle
against counterfeiters, who proliferate on the internet.  Whois helps us
to take down websites that are offering for sale counterfeits and also
helps us identify known counterfeiters who reappear under new domain
names.  While I appreciate the privacy concerns that ICANN is weighing
in its consideration of the elimination of Whois, I must point out that
any entity on the internet that is engaged in commerce should absolutely
be required to identify itself.  Businesses all over the world must
provide such information as a matter of public record, regardless of
where such business is situated.  Businesses and individuals engaged in
e-commerce should not be permitted to hide as any such permission is to
the extreme detriment of consumers, many of whom are not sophisticated
and have no recourse without the ability to identify the source.   As a
matter of both commercial and private interests, elimination of the
Whois system will have grave consequences.
