Additionally, no one should assume that the complainant WOULD be or SHOULD be or inherently COULD be the .com domain holder.

In the court of public opinion, .com is the most desireable and the most powerful. But in a court of law, .com has no more intrinsic rights than .org. And so therefore if ridiculous lawsuits were to become the rule of day (more than they have become), Books.org would have just as much claim on Book.com as the reverse.....from an objective legal standpoint when talking about the inherent rights of the various TLDs.

WIPO, get a grip. It is at least AS important to protect generics as it is to protect trademarks. Otherwise the whole system breaks down--and entering new TLDs becomes meaningless.
