Trademarks are distributed on a first
come first served basis for a specific MARK (not word unless completely original).
Should the MARK in question contain a generic word or category, a DISCLAIMER is included
in the registration which disclaims EXCLUSIVE RIGHTS to that word by the registrant.
Clearly, if the current spate of decisions involving the prejudiced UDRP continues
this will open ICANN and others up to class action suits as the current practices
are contrary to actual TRADEMARK LAW. Domains and trademarks are two very different
things and should be recognized as such.
