You wrote a lot in your message, but failed to answer why your alleged trademark doesn't show up in the USPTO trademark database. Have you even submitted one? Was it rejected according to the guidelines? If not, how can you appeal the guidelines if you haven't even submitted an application? If the trademark rights aren't important as you say, why appeal the law? Might it have anything to do with a lawsuit it's obvious you intend to file if you are not selected to run the .web registry?
