Hello and thanks Thomas,

The NPOC  proposal is for Qualification No. 3 ONLY as Qualification No. 1
(and 2) would exclude truly international organizations that are not
established by treaty. This would unduly favor the Public Sector
Stakeholder to the detriment of the Private and/or the Not-For-Profit
Stakeholder, as only governments can enter into treaties with other
governments. I feel this is essential to the robustness and balance of the
MS model at ICANN, although not everyone at ICANN currently agrees with the
importance of that.

The test of establishing that an organization has an independent
international legal personality (ILP) is extremely arduous to meet and
would therefore not trigger a lot of applications for special protection
(if that is an objective for some!). To refer to concrete but purely
hypothetical exemples, and for illustrative purposes only, The Nature
Conservancy or Conservation International may be able to prove that it
possesses an ILP, but my own organization for instance (CECI - a large
Canadian development NGO - see http://www.ceci.ca/) could not aspire to
possessing an ILP, let alone the almost infinite myriad of small and micro
NGOs in the world. This criteria has the advantage of closing the "flood
gates" for special protection application, but does favor the very large
INGOs with subtantial international ramifications (Same as the treaty
qualification though).

The reason NPOC supports this specific proposal is that it his part of its
vision to increase the relative involvement  of Civil Society in the DNS
and Internet Governance.

Of course, the other proposal that is not unpopular with some at NPOC is
the scenario of "protection for none or protection for all"...but that is
another discussion!!!!
