The court has actually ruled (to my understanding - I've not received my copy of
the decision yet) that NOBODY can hold ANY trademark rights in a top-level domain.
Not even .com.This, in a way, levels the playing field and clears ICANN to create
new registries based on first-use, best-use, and experience.
Image Online Design
has the only commercial-scale registry in operation right now (other than NSI, of
course). If that's no experience, I don't know what is.
As such, I expect ICANN
to make the appropriate decision with regards to our .web registry now that this
trademark issue is behind us.
