        Read Image Online Design, Inc. v. CORE Association and Ken Stubbs, 2000 US Dist. Lexis 10259.

I do not know if a free copy exists anywhere on the Web yet, but it was decided on June 21, 2000 in the United States District Court for the Central District of California.  For those of you who cannot get a copy, let me summarize:

Outcome:  CORE's motion for Summary Judgement was granted because the .WEB service mark did not have source identifying function, or at best was generic, and was therefore not a protectable mark.  Thus, IOD was not able to seek injunctive relief or monetary relief because the mark was not protectable.
