Essentially, the onus would be put on the applicant for special protection
to establish/prove its ILP, either through previous legal jurisprudence or
by hiring lawyers to make a solid case - very constraining so only
convinced and determined INGOs will go through the costs. This would close
the floodgate. Only need is for an ICANN mechanism is a type of review
board, but need to think about that one. Also, ILP would only be part of
ICANN's qualifications and criteria not a panacea or silver bullet.
