Actually, under intellectual property law, trademark trumps domain name. In
other words, cases.web would not infringe cases.com unless cases.com was trademarked.
The U.S. Patent and Trademark Office disregards the gtld in deciding whether to
register a trademark. Therefore, the name "cases.com" would be treated exactly
the same as the name "cases" for trademark purposes. Cases is such a generic
word that it is very doubtful the PTO would grant a trademark (and cases.com is treated
identically). Therefore, even if there is an active business called cases.com,
cases.web would still be an excellent name for my web-based legal business.
