                SCENARIO

  JOHN:

     * John wakes up every morning at 5:00 AM.
     * At 5:15 AM he goes for a 2 mile jog.
     * At 6:00 AM, back from his jog, he showers, gets dressed.
     * From 6:30-7:15 AM, he reads the Wallstreet Journal.
     * At 7:15 AM he signs online, paying bills online,
doing some technology research, checking his stocks.
     * At 8:00 AM he heads off to work.
     * At 5:00 PM he heads home.
     * During the remainder of the evening he takes care
of all his personal and professional business.

One day his 7:15 AM tech research leads John to
discover new TLDs that are pending, and he decides
to put his research to some good, and invests in a few .webs
     for development one day.

Every day for John is similar to the above.

  PHIL:

     * Phil wakes up every morning at 7:45AM
     * At 8:10 he dashes out the door to go to work.
     * At 5:00 PM he heads home.
     * At 6:30 PM he cooks dinner and eats.
     * From 8:00 - 10:30 PM he watches TV on the couch.
     * From 10:30 - 11:15 PM he signs online, reads his
email, forwards a chainletter and 2 joke emails to
his friends. He even forwards a  Cyber-hug every
       now and then.

One day his 10:30 PM online venture brings him to
Amazon.com where he buys a video of
     "The World According to Garp."

Every day for Phil is similar to the above.

TWO MODELS OF "FAIRNESS" REPRESENTED ON ICANN'S PUBLIC
COMMENT MESSAGE BOARD:

MODEL # 1:  Give John the .web his work and foresight have landed him.

MODEL # 2:  Eradicate John's .web to be fair to Phil who will email his friends news of the .web that ICANN had so thoughtfully freed up for him. (How nice to see that they stand for fairness.)
************************************************************

MY VOTE:

No doubt many here believe Model # 2 is the fairest model. These people have an interesting world philosophy and sense of personal liberty.

To me it is clear. Model # 1 above is the ONLY fair model.
Reward John for his foresight and devotion to securing a better life for himself by giving him the .web.

In all honesty, the .web is ALREADY legally and morally John's. It was his the moment he registered it. If Phil winds up with it, it is only because someone TOOK it from John.
