Hey, look. If ICANN were to account for every little possible trademark infringment
before acting, tomorrow would never come. Nor is it feasible for ICANN to account
for every incident of GENUINE infringment--and if they did, I am afraid the rights
of the owners of GENERIC domains will be butchered. Remember: GENERICS NEED PROTECTION
AS FAIR-GAME.
ICANN must tend to the Internet root, and other technical matters.
They have to deal with how registries and registrars operate in a manner that is
fair and proper.
ICANN can NOT be in the business of trademark protection!
If
your trademark is being infringed upon--and you have the legal right to monopolize
the name, word or phrase in ALL venues--then take it up with arbiters (hopefully
they will begin doing their job properly) and judges.
