Threatening to sue and agreeing to indemnify are two very different things. "If you
don't select IOD to run the .web registry, we'll sue" *is* intimidation. "I won't
sue you should any legal challenges arise" is *not* intimidation. They're actually
the exact opposite of each other. Maybe you haven't noticed that all applicants
have been asked (by ICANN) whether or not they would indemnify ICANN should any legal
challenge be brought up concerning the delegation of a TLD. This should be expected,
as it is very common for the issue of indemification to be brought up before an agreement
is entered into. Considering the fact that some individuals (namely IOD supporters)
are already threatening legal action, it would be dumb for ICANN not to ask for indemnification,
regardless of how baseless the threats are.
